In this report the bracelet did not record a thing, and the officials claimed,"...Generally, like I've said, I've never seen that happen myself. For the most part, we catch every little incident that's occurred." That's right, everything such as a pant leg, sock or even a thin sheet getting between the bracelet during dormancy. The innocent are fighting tooth and nail for liberty while the delinquents kick back with a cold one. The use of junk science in our courts does not bring anyone to justice, but merely exploits how the lack of integrity and zeal amongst the legal community are causing harm to not only the offender, but their families as well.

I would like to thank you for your blog. I have been looking for anybody else that has had problems with scram. We live south of Dallas in a very courrupt county. My husband had the scram braclet placed in April of 2005 and it has not been removed due to the amount of false positive results from scram. He has had to serve two four days in jail, one six days in jail and nine months at a half way house for felons. He has been called in by the probation office to leave work 12 other times and drilled by his probation officer and her superior for an hour to a hour and a half, inorder to get him to admit to something he did not do. Weather it be an obstruction or a so called proven alcohol consumption. Sometimes his braclet gets so loose it falls down to his heel and until he gose to get it readjusted it will show up to be a tamper. One time he developed a bad rash and then the skin started bleeding when he went to the probation office they refused to switch it to his other leg we had to hire a attorney. False positive readings and so called tampers have resulted in revocation of probation then reinstated after nine months at a half-way house then four months after that, scram showed an obstruction so they said "Well we can't prove that you drank, however we will never know if you did'nt drink". so to teach my husbad a lesson they gave him another four days in jail. Two of the times it registered a false positive my husband was clocked in at work. The other ten or so times he was at home with me, me being the only witness, which did not matter to them at all. He has had his braclet changed four different times due to errors with the braclet. Now they have revoked his probation once again due to scram and he is currently in jail awaiting court tomorrow. I think that scram might help some people but it has screwed up our lives. We don't understand why our judicial system is allowing this company (scram) to continue to rape us of our money and time. When there have been many proven cases that inocient people are going to jail everyday because of a device that was set up to fail. Upon reading the SCRAM tether by Dennis N. Powers and Daniel Glad it states that "Hawthorne, the inventor of the SCRAM tether, admitted as much during testimony in the case, noting that there are simply too many factors that cannot be controlled, therefore precluding use of the SCRAM tether as a quantitative evidentiary tool. It is only to be used as a screening device". It is a bad cycle, our county is helping SCRAM get rich by placeing their device on people on probation at our expense, and SCRAM is helping our county get rich by providing inaccurate results that help place people back in court and in jail stuck paying more fees. I hope more people start speaking out, about SCRAM and maybe our court system will stop seeing green and start seeing the injustice of this.
Interesting stuff on this site. Today is march 29th. I got my SCRAM on 2 days ago. My problems started the second i was sentenced to it. My probation officer, FULLY AWARE THAT I ONLY HAD A CELL PHONE, told me the device needed to be plugged into the wall once a day, leading me to believe she meant, electrical outlet, not phone outlet. She then informed me of the cost, which was WAY more than i had expected. I had figured on around 250, 300... but 472 to start and 372 each month after? Yeah. Killing me, and at this point, their was no going back! When i went to H.A.S. in eastpointe, mi., i was informed that i needed the phone line. My moms boyfriend has a business line in the basement, but that is through WOW... and their system isn't compatible with WOW or Comcast. Great. I am informed that i must NOW come in 3 times a week to download data at their office. My license is suspended, and thats a bit of a drive for me. Next, I tell th lady, i travel for work, thats why i asked (yeah, stupid move, i know now) for this device. She tells me that i cant even take the modem on the road with me, as it will not work in a hotel, because most dial 9 to get an outside line. *sigh* I knew i was getting screwed right there, but i was still feeling confident that this would not be THAT terrible. Until i got to the sheet about not using certain items. Thats when i knew this was going to get hairy. I work around all sorts of chemicals in my job. I don't know what im around half the time, since im a salvager in shut down plants, like the GM validation center in Pontiac. I get to the point where the woman is putting the anklet on me, and i wore my work boots in, since those are what i normally wear. She tells me they wont work. I tell her without them I CANT WORK, and with what i pay THEM, their is no way i can buy new boots anytime soon. She tells me she is going to put it on loose, and to be extra careful not to get anything between the tether and my skin. *sigh* Without my boots on my legs must stay horizontal or it falls to my foot. When i wear the boots, it leaves deep indents on my skin. Super. Well... when i saw how shady this device was, i started trying to figure out ways to protect myself, since my lawyers advice to get a blood test or a PBT if i had a false positive is impossible to take, and this site is what i find. I am quite nervous about failing, as i have horrid luck, and know that their is no possible way i can afford to fight any sort of probation hearing with my level of debt. I have been played for a fool by the system, as their is no way to take the alternative of daily PBTs, in house OR at the Royal Oak courthouse, since i travel. I wish i had done research before getting this option. Now im poor, nervous, and angry.
One question to end this if i may... I have tattoos on both calves, inner and outer on one... Do you know if this affects the obstruction readings? The tats are grayish, with skin showing on one leg, and DARK on the other... so this may affect the reflection. If so... I give the hell up. THANKS!
To my knowledge, tatoos have not been carefully studied, allthough it is said that differences in epidermal tissue are accounted for in the initial read (when they put it on). However, I have yet to find any research on alcohol readings (muted or accelerated) or obstructions with differences in skin type, tatoos or other skin conditions. I can only wonder if dead skin from the abrasion was the cause for the read that resulted in a conviction?? Dealing with H.A.S., you will find that they are not professional, will lie to further their cause, and will not comply with the Sixth Amendment-Notice of Accusation, thus you will not be informed of a positive (false or not) with reasonable certainty that you can create a defense with a PBT. I would suggest EtG, but if you are working around chemicals, hand sanitizer etc... it will only corroborate. The good news, 80% of wearers make it through without a problem, and I'am confident a third of the remaining 20% are guilty, so there is a good chance to escape the injustice-Good Luck

Hey, thanks for the response... the last line... the 80/20 thing kinda put my mind a bit more at ease. I actually just got home from SCRAM, and i was listening to one of the ladies falsely explain a few things about the SCRAM, and then tell the guy he shouldnt even know what a spike in his system means. They actually told him to stop calling them with questions, because every time the man called about anything regarding his worries about the tether, they reported it to his P.O. I understand not wanting to give out to much information, as to avoid scammers, but he, like many of us, are worried about all the products on the market that can read false positive. She told him if he was really worried, ask a STORE PHARMACIST about it, as it was not HAS's responsibility to inform him what chemicals can show the positive readings.She also tried to tell him that a P.O. would get with him within a day if he did test positive. We left about the same time, so i informed him a bit how the tether works, and i directed him towards your blog for a less biased opinion... or at least a view from the other side. I know i shouldn't have done that in front of the HAS people, but i cannot stand hearing the company line given, when it is misleading, mis informative, and when it just causes a person more stress, and leaving the person with nowhere to ask questions. P.S. it was kinda funny that she inadvertently let out a little slip of potentially big info... I am going out of town for possibly 2 weeks with no way or no where to download. She told me to make sure i downloaded the day i was leaving, because if not the memory could get full... and not be able to record my stats. I figured, of all the benign things they could say, that must have been one of the dumbest things to say to someone going out of town. Its not really info i feel like testing, but it was just humorous to me what they would let slip.

I have had my Scram unit of for about 2 months now and for the most part have only had a few problems until lately. First thing that happened was that when i showered water got in it, so i had to go in and get a new one put on. Now all of a sudden I am getting reads that i have been drinking. The times that these reads are very ridiculous also. The occur when i am sleeping. One of the first readings happened at 5 in the morning and lasted all the way to 8:30 in the morning. The next alcohol reading came four days later and went from 7 in the morning to 8 in the morning. Now i have to go back to court because they are saying i violated my probation. I have witnesses for both times that the scram unit said i was drinking.
I dont understand how they can tell if you drank something or if it got on your skin, since it measures in sweat.
Any help would be greatly appreciated with what i should do
I am completely exasperated at how inaccurate my scram device has proven to be. I have had scram on for about 3 months now. During this three month period, I have had 3 different bracelets. My first bracelet worked fine for a couple of weeks and then started showing signs of tampering. I got called into A&D at least 5 different times during a 2 week period to have them investigate for signs of tampering. When they found no signs, they then said my core temperature was reading too low and accused me of submerging it to hide readings. This was not the case. I have in no way ever submerged my device, I have only taken showers and am careful to dry it off after each time. Finally, they switched this bracelet out and gave me a new one and a new modem. Surprisingly, the second bracelet worked fine. I had no problems with it at all. That's when I knew something had to change. They called me in one day and out of the blue gave me a new one saying that there was a software update. I was a little skeptical, but what could I do about it? That was 2 weeks ago. Since I have had the new bracelet (which they put on way too tight and is causing sores on my ankle, and when I asked if they could loosen it, they said the guy who does that is on vacation and it would be a few more days) I have once again shown signs of tampering, problems communicating with the modem, and just recently I had a false positive reading. This reading occurred just after I got home from a 12 hour shift! I got off work at 6am and went to bed promptly at 6:30am, and then got a false positive for alcohol consumption from 7 - 9:30am. I am completely beside myself. I don't know what to do. I have been clean and sober for 99 days now and in that time period I have been accused several times of drinking, tampering, and other serious accusations. Furthermore, I never received any paperwork on my scram device. I don't know what I can and can't use, I don't even know when my download time is. They told me I need to stand by my modem during my download time, but upon several requests by me to find out when that time is, nobody can seem to tell me!!! I was told if I didn't drink and paid my fines all would be fine. This has not proven to be the case. The very device which is designed to prevent me from drinking is driving me to it!!! I am completely beside myself and not for sure how to proceed.
We are gathering data to stop this nonsense. please if you really want answers or help please provide your contact email- that way we can discuss getting us all together. alone we will lose- together we can fight.

I hot arrested today in my 9:30am Accounting class because i was "tampering" with my device the day before for 18 hours. They said that I deliberately placed something in between the device and my skin for 18, 10 of which I was working for my dad who paid for the device to be put on. This SCRAM device is a SCAM device! To top it off the judge placed a $5000 bail and told me just because I had a lawyer doesnt meen I can get away with everything. AHHHHHHHHHHH!
i was arrested on domestic v. my wife didnt want to press charges but they took me anyway. as a condition of my pretrial release i should have no-contact with my family and i have a scram on my ankle. i have to download at 2am everynight can they tell were i plug the device such as my house?
You should have set up a phone number with them, yes they can tell where you upload from.
I am so thankful that I have found a site where there are others experiencing the same problems. My boyfriend is sitting in jail accused of tampering with the SCRAM. This is the third time they have accused him of this. He had repeatedly called his probation officer telling him the device did not work properly and they told him repeatedly that it was fine. His probation officer does not want to hear anything. I'm at a loss of what to do. He was at work when he supposedly tampered with this. That was four days ago. He goes to alochol cousneling three times a week meets with his probation officer regularly and once when he was accused of tampering with it, he was even with his alcohol counselor. Actually, the device probably did work properly as in my case. A sock, pant leg or simply the tether fell down the leg an inch can read as a tamper. To prove he was not drinking or create doubt, a sock, cardboard, saran wrap and a black trash bag all failed to mask an actual drinking episode during AMS's research. Was there alcohol detected?

This is my first time visiting this site. I have had the scram on for three months now. I live in New Orleans and they did change mine once due to "maintnence proceedures"... Yea right. I am not on probation nor did I get a dwi. I have this on because I was accused of picking up my daughter from school drunk. This is obserb. I had 102 fever and drank niquil. I did not drive myself to pick her up but did go into the school to check her out as she also had fever and a nose bleed. I was delerious from the fever and I'm sure I appeared intoxicated but I can assure you I had not been drinking and did not drive there or home. With the help of my so called father- who is a hibitual pot smoker- told OCS that I was an oblivious drunk always falling down drunk, driving drunk and what ever else he threw in there. They took custidy of my daughter in Dec. 2006. Still in state custidy I to have a SCRAM. I think both OCS and this SCRAM are SCAMS. Money rackets. I am not a criminal. Now OCS is also hair testing me for drugs at my expence... I am a single parent not a criminal and I can not afford a lawer so this saga continues at my expense... Please help!!!
Sounds you need a lawyer, without actual evidence a good lawyer would eat that up in court. I know financing it is tough, but you're going to pay one way or another.

I'm so glad to have found this blog, although not thrilled to hear what some of you are experiencing with the ineffectiveness of SCRAM. I have been holding up alright, starting on my third week with this device. I got called into the office 3 days after I got it to "exchange" the one I had. And once I got a phone call saying the download didn't go through and I would need to do it manually. Knock on wood, I have yet to hear of tampering reports or drinking incidences. I am being quite cautious causing me to have incredible paranoia and desires to crack open a bottle of sweet red wine. GEEEZZZZ! I actually am adorning two lovely anklets. The SCAM and GPS--all due to DUI I got on spring break. I can't go anywhere or drink anything on this beautiful labor day. Oh, the time will pass. I just got my device yesterday and I am scared to death - not as scared as with being in jail in solitary 24/7.
I am such a scrawny person even the P.O. wasn't sure if it would stay on me correctly. This will be as stressful as jail. No one believes anything any of us say, anyway, so tell me how to do this.
I have had my device on for 7 months now. I haven't drank once in those 7 months however I have gotten about 5 harrassing phone calls from the SCRAM people accussing me of drinking. One time was when I was playing tennis with my Dad!!! I just got a call last night saying that I had an obvious consumption and they were going to file a report with the state's attorney. They claim on Saturday night I was drinking. I have 15 people who were with me at that time and they all know about my ankle bracelet and saw me drinking Sprite. I am getting so fed up with this. What happens when I get a "positive reading" and I am home alone with no witnesses??? Has anyone had these false readings reported to the court and what was the outcome when this happened??? Thanks for your help.
I was convicted of "obstruction" however no alcohol detected, because there was none consumed. Even their study showed a black trash bag, sock, saran wrap and cardboard all failed to mask a drinking episode. I beat the so-called "confirmed consumption" with credible witnesses. I'd suggest find the cause of the read and avoid it at all cost. Unfortunately my obstruction could have been pants, sock or dead skin from the abrasions (yeah AMS, I still have the pictures) the bracelet caused.

I have 15 people I was with who will all testify for me that I wasn't drinking. How many people did you have testify for you? Any recommendations? Thanks for your words of encouragement!
Was charged with both, and this is treated as typical allegations: arraignment then weeks later a hearing and a month later sentencing. I had 2 witnesses and 2 affidavits, 2 of my witnesses were the business owners for I had worked 14 hours at 2 jobs that day. One of which had a liquor license, perjury in a case such as this would cost her not only her livelihood but her investment. The obstruction was a different story, happened after my shower while at home with my then 2 year old daughter. However that was 4 years ago, today they have to be aware the ongoing claims of the devices reliability. One thing, this device says it read something, that I believe, it does work it just cannot distinguish between incidental contact and consumption. Good Luck!
when you were cleared of the "positive consumption" did they basically just drop it as if nothing happened or did the judge instill anything else on you? i.e. another month of wearing the bracelet.

sorry about that, i saw conviction and got a little confused. i am just nervous, frustrated, etc etc with this whole thing. i am looking forward to moving on with my life and learning from this whole process rather than living this nightmare.
Certainly understandable, been there. The whole reason I published my research is because I believe had I this knowledge at the time of my hearing I would have created reasonable doubt. Science that does not meet the standards of Daubert has no place securing convictions.
Well... word has come back that after the state's attorney read all 13 letters I got from the people I was with on my supposed "drinking night" that they are willing to cut a deal. All of the letters state that I WAS NOT drinking on the night I am being accussed of. The SCRAM claims I drank from 9 PM - 7:30 AM with a peak TAC of .05! Thats a long time of drinking to be at that low of an alcohol reading. But the State's Attorney will grant me a deal of dropping this if I agree to an additional two months of wearing this thing. I have already worn it for almost my full sentence of 9 months! I was supposed to be done in April! This is RIDICULOUS. My lawyer tells me we can go to a hearing, but because it is a parole violation not a criminal violation the judge just has to find a ponderance of evidence not beyond a reasonable doubt. And most of the time the judges will side with the SCRAM because they believe it is a reliable device. Obviously, if they didn't think it was reliable they wouldn't sentence people to wear it and then they wouldn't make alllll this money off of it. This is absolute corruption at its best. So frustrating, I don't know what to do. Any thoughts?
Facing jail, the fight almost seems a dumb move, but I'd check into a physiologist. They can prove the read is not a drinking episode because the human body cannot metabolize alcohol in this manner. With the witnesses and scientific proof it will create reasonable doubt. Your read is indicative to most false-positives, that is they last 8 to 16 hours. There has been a problem in the past with water accumulating in the bracelet, ethanol is miscible with water which may explain the retarded diffusion and again help create doubt. How long have you worn this particular unit? The longer the term the more susceptible to erroneous reads.
I have had this same unit on since July 11, 2008, with a week and a half break between Dec 31 to Jan 12 when I was on vacation. They then put the same unit back on. I also heard that if you didn't eat all day that could also cause problems as all I ate that day was breakfast around noon. It is ridiculous. However, my lawyer told me that for probation violations the judge just has to find evidence that I was drinking not proving beyond a reasonable doubt. I am supposed to be getting engaged in a month and a half and this thing is just becoming a nightmare. I don't want to take this deal and then have it go off again for some reason!
Marcellus...I read your article you recently posted. Do you know where SCRAM has specifically stated that alcohol is airborn?? This is what I have been saying all along! This gives ample proof of the reason my device went off when it did being that I was in a small, one bedroom apartment, with all windows shut (due to the cold) and we squished 15 people in there to watch the fight on Pay Per View, most of whom were drinking.
Where does SCRAM specifically say, I actually had to think a minute before my reply, how about the contract you signed, how about their "White Paper", they claim they can tell the difference between a drinking episode and environmental exposure, yet you had to sign a contract stating you would refrain from using products containing ethanol. Let us not forget the device is non-specific, meaning other forms of alcohol and a slew of things such as yeast will register as well.
I have had my scram for all of 7 days, and already my case mgr says it showed an alcohol incident - I said absolutely not - rechecked some of my products only to find more "...ol" s in there - so I am bringing them all in. I may get nailed for admitting to cooking sherry - but I honestly thought it had all burned off - hopefully they won't jump down my case. the other thing I asked was what exactly is the pulse that comes out - electric, laser - what and he didn't know - wht's that about?
this is insanity - then I go in and they give me a BA - isn't that redundant?
All I have to say is DO NOT be around alcohol. Its just not worth it. The device can and will pick up alcohol from the outside environment. If you are at a bar or around people drinking just leave. Thats what I have now had to do for the past 2 months. I have 1 month left and will maintain being a hermit for the time being. It sucks but thats the only way I won't have to go back to court.
I was convicted for wearing socks, or pants, possibly string from a towel or dead skin from my abrasion! These are the only possible artifact that registered as an obstruction.
i have been wearing scram for 39 days. i work as a bartender and so far it hasn't picked up any alcohol. however,i had a tampering incident from a pair of socks going between the scram and my leg and now we are having download problems.This little beauty costs me 168.00 every two weeks plus the cost to have it put on. i have till june 23rd and hopefully won't have any more problems.
Hi everyone. I was on the scram monitor for about 4 days and then chose to have it taken off, as I had a choice to either have the scram or participate in our states 24/7 sobriety program, which in itself is a major pain. I have to go to the county jail and take a pbt test twice a day for a year!!! I must say though, that it is much better than the scram monitor. It caused me so much anxiety and physical pain. it was heavy and would sit on my ankle bone. It also caused a huge rash in only 5 days. I was so obsessive about any products that i used. I called my officers numerous times a day and they were clearly irritated. I dont care though. If I violated, I would go straight to jail. Does anyone know if I need to be paranoid about anything I eat with the pbt's?. I do not want to fail this. I have been sober for many months. I am also on electronic monitoring for house arrest! I will be so happy when this all goes away. I must say that it has scared me from ever drinking again. I just think that there has to be a better way than the scram monitor.
Pbt's are non-specific as well. Avoid eating yeast or smoking products right before the test and most likely you'll be fine. Inhalants, don't clean windows right before or use hand sanitizer. This is a far better option for you will know right away if there is a positive and be able to have further tests and you are face to face with the monitoring officer.

I was also wondering if ingesting vinegar could make you fail a breathalizer test?
Well, the devices are non-specific, avoid sucking down vinegar before the test! However, an EtG test will prove positive. They say even food made with wine will show, I believe this is more an atomic test than a consumption test, but the courts still use them. Justice doesn't create revenue!
I want to leave town for the weekend, I failed to get permission from my Probation officer, I know it's not the best of ideas, but it's a family emergency. My question, will SCRAM show that I left the state for a couple of days? I have to go in and download on Monday, which is no problem, I'm just paranoid perhaps about what all this thing can do.

Thank you for the blog, first of all... it's calming to know that people are talking about this SCRAM device. I had mine put on today, and learned today that I could not use any products, what-so-ever, that contained alochol (mouth wash, body wash, shampoo, conditioner, hand sanitizers, lotion etc) and could not be in a room where products with ammonia were being used. Here is the problem....
I am a registered nurse and I use antimicrobial foaming hand rub all the time at work (as hospital policy, and any peer review shows that antimicrobial hand sanitizers are more effective in preventing spread of certain germs, including C. DIFF). Is there any way that my usage of antimicorbial foaming hand rub (with 62.5% ethyl alcohol) cause me to be false positive (esp with an ankle device? It seems to me that the area would be too far away for it to pick up... but who knows.
In addition, patients are frequently discharged off my unit and the housekeepers use cleaning agents such as bleach and other agents that produce noxius fumes. I was told that I was not allowed to be in a room where fumes produced by cleaning agents are strong. And, not only do the housekeepers use the cleaning agents, but I will also, if I spill blood etc. Does this often create a false-positive?
I shared all of these things with the person who hooked me up to the device, and she said that we would give it a "trial one week run". I should have asked for that in writting. Im afraid of testing false positive because of my job.
This is my first day on and already Im sick of worrying about it.

They tell you to stay away from it, the initial and still one of the only researches shows a wearer that had a read because they worked in an area where alcohol was used to clean computer circuitry. They referred to this as an anomaly. Plenty of radio waves for you as well, but you probably know EtG is a near guaranteed false-positive, and with this contraption it is time/date stamped. Cameras, witnesses & the fact they can't ask you to stop working should make a read an easy defeat, get the media involved, they love it. One case the girl was allowed to model, then taken to court (proven hairspray), prosecuter tried to say she drank little bits at a time for 13 hours!
Good thing they are allowing me a one week trial run with this, to see if the antibacterial hand sanitizer that I use at work will interfere. If it does, I will probably be switched to something called the "sobrietor".
Do you think I could make a case for hospital equipment interference when the device is battery powered? Have there been reports of these little guys causing interference?

Unfortunately, water accumulating in the sensor (ethanol is miscible with water) has been the escape goat, I don't believe one week is the time needed to do any integritous research which has been their shortcoming for 5 years.
A musician's read was determined RFI by a judge.
Any comments on the sobrietor?
I'd say it is better than SCRAM but again it won't distinguish the difference between Windex and vodka. Unfamiliar with the read outs, if they are reading higher than the SCRAM's .08 then a definite upgrade. AMS took me to court on a read, yet nobody knows what it was, just that it was over .08, could have been 7.08!!
